Emigration Rules in Passport: ECR, ECNR and Emigration Clearance Explained
Under the Emigration Act, 1983, certain Indian workers need emigration clearance from the Protector of Emigrants before going abroad for a job in specific countries. This depends on whether your passport is ECR (Emigration Check Required) or ECNR (Emigration Check Not Required). This guide explains who needs clearance, which countries are covered, how to get it through the eMigrate portal, and how to move from ECR to ECNR.
Key Features
- Clearance is needed only when all three are true: your passport is ECR, the destination is an ECR country, and you are going for employment.
- Tourism, study, family visits and transit do not need emigration clearance, even with an ECR passport.
- ECNR passport holders do not need clearance for any country or purpose.
- ECR clearance is obtained online through the eMigrate portal (emigrate.gov.in), run by the Ministry of External Affairs.
- Passports of people with education below Class 10 (matriculation) are generally issued as ECR. Class 10 pass or above is generally eligible for ECNR.
- Children below 18 years do not need emigration clearance.

ECR Countries (Clearance Needed for Employment)
- The Ministry of External Affairs notifies the list, and it has been changed from time to time. A 2026 MEA document refers to 19 ECR countries. Always check the current list on emigrate.gov.in before travelling.
- Commonly listed countries: UAE, Saudi Arabia, Qatar, Oman, Kuwait, Bahrain, Malaysia, Jordan, Lebanon, Iraq, Libya, Syria, Yemen, Sudan, South Sudan, Afghanistan, Indonesia, Thailand and Brunei.
- Going to any other country for a job does not need emigration clearance.
How to Get Emigration Clearance (ECR Passport Holders)
- Check the last pages of your passport. If it carries the ECR endorsement and your job is in an ECR country, you need clearance.
- Get your job offer only through a registered recruiting agent or a genuine employer. The list of registered agents is available on emigrate.gov.in.
- Register on the eMigrate portal. The employer or recruiting agent initiates the proposal with your employment contract and visa details.
- Keep your valid passport, valid employment visa, signed employment contract and the mandatory insurance for ECR workers ready, as asked on the portal.
- After the proposal is approved by the Protector of Emigrants, you receive the emigration clearance online. Keep a printout with you.
- Carry the clearance and the visa documents to the airport. Immigration officers check them at departure, and travel without clearance can be stopped.
How to Convert ECR to ECNR
- Apply for a Re-issue of Passport on Passport Seva and select the option for changing ECR status to ECNR.
- Submit proof of eligibility, such as a Class 10 or higher certificate, a degree or diploma, or documents for another exempt category.
- Carry the old passport, the proof documents and self-attested copies to the PSK. The fee is the normal re-issue fee.
- If your passport was marked ECR by mistake although you qualify for ECNR, get it corrected from the passport office before you travel.
Important Points
- Never go abroad for a job on a tourist or visit visa. It is illegal in many countries and a common method used by fraud agents.
- Do not pay anyone "for guaranteed job or clearance". Verify the recruiting agent on emigrate.gov.in before paying anything.
- Keep copies of your passport, visa, contract and clearance, and share them with your family.
- Iraq and some other listed countries also have separate travel advisories. Check the MEA advisory before planning travel.

ECR देश (नौकरी के लिए क्लीयरेंस ज़रूरी)
- यह सूची विदेश मंत्रालय अधिसूचित करता है और समय-समय पर बदलती रही है। 2026 के एक MEA दस्तावेज़ में 19 ECR देशों का ज़िक्र है। यात्रा से पहले emigrate.gov.in पर ताज़ा सूची ज़रूर देखें।
- आमतौर पर सूची में शामिल देश: UAE, सऊदी अरब, कतर, ओमान, कुवैत, बहरीन, मलेशिया, जॉर्डन, लेबनान, इराक, लीबिया, सीरिया, यमन, सूडान, दक्षिण सूडान, अफगानिस्तान, इंडोनेशिया, थाईलैंड और ब्रुनेई।
- इनके अलावा किसी और देश में नौकरी के लिए जाने पर इमिग्रेशन क्लीयरेंस की ज़रूरत नहीं है।
इमिग्रेशन क्लीयरेंस कैसे लें (ECR पासपोर्ट धारक)
- अपने पासपोर्ट के आखिरी पन्नों पर देखें। अगर ECR की मुहर/एंडोर्समेंट है और नौकरी ECR देश में है, तो क्लीयरेंस ज़रूरी है।
- नौकरी का ऑफर केवल पंजीकृत रिक्रूटिंग एजेंट या असली नियोक्ता से लें। पंजीकृत एजेंटों की सूची emigrate.gov.in पर मिलती है।
- eMigrate पोर्टल पर रजिस्ट्रेशन करें। नियोक्ता या रिक्रूटिंग एजेंट आपके रोज़गार अनुबंध और वीज़ा की जानकारी के साथ प्रस्ताव शुरू करता है।
- पोर्टल पर मांगे अनुसार वैध पासपोर्ट, वैध रोज़गार वीज़ा, हस्ताक्षरित रोज़गार अनुबंध और ECR कामगारों के लिए अनिवार्य बीमा तैयार रखें।
- प्रोटेक्टर ऑफ एमिग्रेंट्स से प्रस्ताव मंज़ूर होने पर इमिग्रेशन क्लीयरेंस ऑनलाइन मिल जाता है। उसका प्रिंटआउट साथ रखें।
- एयरपोर्ट पर क्लीयरेंस और वीज़ा के कागज़ साथ ले जाएं। इमिग्रेशन अधिकारी जांच करते हैं और क्लीयरेंस के बिना यात्रा रोकी जा सकती है।
ECR से ECNR कैसे कराएं
- पासपोर्ट सेवा पर Re-issue of Passport का आवेदन करें और ECR से ECNR कराने का विकल्प चुनें।
- पात्रता का प्रमाण लगाएं, जैसे 10वीं या उससे ऊपर का प्रमाणपत्र, डिग्री या डिप्लोमा, या किसी अन्य छूट वाली श्रेणी के दस्तावेज़।
- पुराना पासपोर्ट, प्रमाण दस्तावेज़ और स्व-सत्यापित कॉपी लेकर PSK जाएं। फीस सामान्य री-इश्यू फीस ही है।
- अगर आप ECNR के पात्र हैं लेकिन पासपोर्ट गलती से ECR बन गया है, तो यात्रा से पहले पासपोर्ट कार्यालय से उसे ठीक करवाएं।
ज़रूरी बातें
- नौकरी के लिए टूरिस्ट या विज़िट वीज़ा पर कभी विदेश न जाएं। यह कई देशों में अवैध है और फर्जी एजेंट इसी तरीके से ठगते हैं।
- "पक्की नौकरी या क्लीयरेंस की गारंटी" के नाम पर किसी को पैसे न दें। पैसे देने से पहले emigrate.gov.in पर रिक्रूटिंग एजेंट की जांच करें।
- पासपोर्ट, वीज़ा, अनुबंध और क्लीयरेंस की कॉपी अपने पास रखें और परिवार को भी दें।
- इराक जैसे कुछ देशों के लिए अलग से यात्रा एडवाइज़री भी होती है। यात्रा की योजना से पहले MEA की एडवाइज़री देखें।
