Old vs New Tax Regime for FY 2025-26 and FY 2026-27: Slabs, Rebate, Deductions and Which One Saves More
Every individual taxpayer has to choose between the old and the new tax regime. The new regime is the default. Here are the slabs for both, the zero-tax limit, which deductions each allows, and a simple way to decide.
Key Points
- The new regime is the default. If you do nothing, your tax is worked out under it. You must opt for the old regime if you prefer it.
- Budget 2026 made no change in income tax slabs, rebate or standard deduction, so the same slabs apply to FY 2025-26 and FY 2026-27.
- Under the new regime, income up to Rs 12 lakh is tax-free because of the rebate under section 87A of up to Rs 60,000, and a salaried person gets there at a gross salary of Rs 12.75 lakh.
- The new regime allows very few deductions. The old regime allows many, such as 80C, 80D, HRA and home loan interest.
- Salaried taxpayers can choose again every year. Business and professional taxpayers have a limited right to switch back.
New Tax Regime Slabs (FY 2025-26 and FY 2026-27)

| Rs 20 lakh to Rs 24 lakh | 25% |
| Above Rs 24 lakh | 30% |
- Health and education cess of 4% is added. The same slabs apply to all ages in the new regime.

What Each Regime Allows
| Item | New regime | Old regime |
|---|---|---|

| Section 80C (PPF, ELSS, EPF, LIC and others) | Not allowed | Up to Rs 1.5 lakh |
| Section 80D health insurance | Not allowed | Allowed |
| HRA and LTA exemption | Not allowed | Allowed |
| Home loan interest on a self-occupied house | Not allowed | Up to Rs 2 lakh |
| Extra NPS deduction, 80CCD(1B) | Not allowed | Up to Rs 50,000 |
| Employer NPS contribution, 80CCD(2) | Allowed | Allowed |
| Section 87A rebate | Up to Rs 60,000, income up to Rs 12 lakh | Up to Rs 12,500, income up to Rs 5 lakh |
How to Decide Which Regime Is Better
- Work out your total tax under the new regime, using the slabs above.
- List your deductions you can actually claim under the old regime: 80C, 80D, HRA, home loan interest, NPS and others.
- Work out the tax under the old regime after those deductions and the Rs 50,000 standard deduction.
- Compare the two. The lower tax wins.
- As a rough guide, the old regime tends to win only when your total deductions are large, often above about Rs 4 to 5 lakh at higher incomes.
- Tell your employer your choice at the start of the year, and you can still change it while filing the return.
- Check on screen: menu names, fees and steps on government portals can change. Follow what the official screen shows.
Precautions
- Do not buy an insurance or investment only to save tax. Buy it only if it fits your goals.
- Choosing a regime at the employer only affects TDS during the year. The final choice is made in the ITR.
- The Income-tax Act, 2025 applies from 1 April 2026 with renumbered sections, but the slabs and benefits described here stay the same for FY 2026-27.
