What is a BOI?

A Body of Individuals (BOI) is a group of individuals who come together voluntarily to earn income, with a common intention and some form of agreement. Unlike an AOP, only natural persons can be members; companies, firms or other entities cannot join a BOI.

PAN and Aadhaar of all members
Passport size photographs
Address proof of the business place
Bank statement of members
BOI agreement signed by all members

How to Form a BOI

Decide members, objective and profit-sharing ratio
Sign a written BOI agreement on stamp paper
Apply for PAN in the name of the BOI
Open a bank account in the BOI's name
Take GST or other registrations if needed

Taxation

If members' shares are known and determinate, tax follows the rules for those shares
If shares are indeterminate or unknown, tax is charged at the maximum marginal rate (Section 167B)
The BOI files its own return (ITR-5)
Members' liability is generally unlimited, as a BOI is not a company

BOI कैसे बनाएं

सदस्य, उद्देश्य और लाभ-बंटवारे का अनुपात तय करें
स्टाम्प पेपर पर लिखित BOI समझौते पर हस्ताक्षर करें
BOI के नाम से PAN के लिए आवेदन करें
BOI के नाम से बैंक खाता खोलें
ज़रूरत हो तो GST या अन्य रजिस्ट्रेशन लें

यदि सदस्यों के हिस्से ज्ञात और निश्चित हैं, तो उन हिस्सों के नियमों अनुसार कर लगता है
यदि हिस्से अनिश्चित या अज्ञात हों, तो अधिकतम सीमांत दर से कर लगता है (धारा 167B)
BOI अपना रिटर्न (ITR-5) खुद भरता है
BOI कंपनी नहीं है, इसलिए सदस्यों की देनदारी आमतौर पर असीमित होती है
