What is RERA Registration?

Under the Real Estate (Regulation and Development) Act, 2016, promoters must register their project, and agents must register themselves, with the state Real Estate Regulatory Authority (RERA) before advertising, booking or selling any property.

Each state has its own authority and portal, for example RERA Rajasthan at rera.rajasthan.gov.in. The Act brings transparency and protects homebuyers.

Who Needs It?

• Promoters, builders and developers of projects above 500 sq. m. of land or 8 apartments (each phase is a separate project)
• Real estate agents and brokers dealing in RERA-registered projects

Usually exempt

• Small projects up to 500 sq. m. or 8 apartments
• Projects with a completion certificate before RERA
• Renovation or repair without fresh sale or allotment

States can lower these limits, so check your state rules.

Documents Required

Promoters

• PAN and identity proof
• Title deed and land documents, encumbrance details
• Approved layout and building plans, commencement certificate
• Form B affidavit
• Architect, engineer and CA certificates
• Draft allotment letter and agreement for sale

Agents

• PAN, ID and address proof, photograph
• Business address proof and incorporation or partnership papers (for firms and companies)
• Details of any previous RERA registration

How to Register – Step by Step

1. Open your state RERA portal.
2. Create an account as Promoter or Agent.
3. Fill Form A (promoters) or the agent application.
4. Upload the documents in the required format.
5. Pay the registration fee online.
6. Submit and note the application number.
7. The authority reviews it, usually within 30 days; if no decision is given, the project is deemed registered.
8. Receive the RERA number and certificate.

In practice it can take 30–60 days. Promoters must show the RERA number in all advertisements.

Validity & Renewal

• Project: valid for the completion date declared by the promoter. It can be extended only for force majeure or other genuine reasons, up to one year in total.
• Agent: valid for 5 years, then renew using Form J.

After Registration, Remember To

• Update project progress on the RERA portal (quarterly updates)
• Deposit 70% of buyer payments in a separate project account
• Follow the approved plans and share project details with buyers
• Keep accounts audited and certified
• Complete possession and handover as promised

Penalties for Non-Compliance

• Project not registered: penalty up to 10% of the project cost, and imprisonment up to 3 years if the default continues
• False information: up to 5% of the project cost
• Agent not registered: ₹10,000 per day, up to 5% of the property cost
• Not following tribunal orders: imprisonment and fines
