Society Registration in Rajasthan – NGO / Association Registration

What is a Society?

A society is a non-profit, member-based organisation formed for charitable, educational, literary, scientific, cultural or similar purposes. In Rajasthan it is registered with the Registrar under the Rajasthan Societies Registration Act, 1958. A registered society is a legal body that can hold property, open a bank account and sign contracts in its name.

Who Can Form One?

At least 7 adults (18+ years) who sign the memorandum
NGOs, clubs, trade or professional associations, resident welfare associations and sports or cultural bodies
Profit-making business is not the purpose; any surplus is used for the society's objects

Documents Required

Memorandum of Association with society name, objects and details of the governing body
Rules / bye-laws, signed by members and attested as required
ID and address proof (and PAN) of all founding members
Proof of the registered office address with owner's NOC
Cover letter, declaration and minutes of the founding meeting
Passport size photographs of members

The name must be unique and should not suggest government patronage or misuse protected names.

Registration Process

Decide the name, objects and governing body (president, secretary, treasurer)
Draft the memorandum and bye-laws
Collect member documents and signatures
File the application and documents with the Registrar (online through the state portal / e-Mitra, or at the office)
Registrar verifies the documents
Certificate of Registration is issued

It usually takes around 4–8 weeks.

Fees

The government fee is set by the Rajasthan government and the fee for a society is modest, plus stamp duty on documents. Professional charges are separate.

After Registration

Open a bank account in the society's name
Hold regular meetings and maintain accounts and minutes
File the annual details and changes of governing body with the Registrar as required
Apply separately for PAN, and for tax benefits like 12A and 80G if you want them

सोसाइटी क्या है?

सोसाइटी एक गैर-लाभकारी, सदस्य-आधारित संस्था है जो धर्मार्थ, शैक्षिक, साहित्यिक, वैज्ञानिक, सांस्कृतिक या ऐसे ही उद्देश्यों के लिए बनती है। राजस्थान में यह रजिस्ट्रार के पास राजस्थान सोसाइटी रजिस्ट्रीकरण अधिनियम, 1958 के तहत रजिस्टर होती है। पंजीकृत सोसाइटी एक कानूनी इकाई है जो संपत्ति रख सकती है, बैंक खाता खोल सकती है और अपने नाम से अनुबंध कर सकती है।

कौन बना सकता है?

कम से कम 7 वयस्क (18+ वर्ष) जो मेमोरेंडम पर हस्ताक्षर करें
NGO, क्लब, व्यापार या पेशेवर संघ, रेज़िडेंट वेलफेयर एसोसिएशन और खेल या सांस्कृतिक संस्थाएं
उद्देश्य लाभ कमाना नहीं है; कोई भी अधिशेष सोसाइटी के उद्देश्यों में ही लगता है

ज़रूरी दस्तावेज़

मेमोरेंडम ऑफ एसोसिएशन, जिसमें सोसाइटी का नाम, उद्देश्य और प्रबंध समिति का विवरण हो
नियमावली / उपविधि, सदस्यों के हस्ताक्षर और ज़रूरत अनुसार सत्यापन सहित
सभी संस्थापक सदस्यों के ID और पता प्रमाण (तथा PAN)
पंजीकृत कार्यालय के पते का प्रमाण और मालिक का NOC
कवर लेटर, घोषणा और स्थापना बैठक का कार्यवृत्त
सदस्यों के पासपोर्ट साइज फोटो

नाम अनोखा होना चाहिए और सरकारी संरक्षण का आभास नहीं देना चाहिए, न ही संरक्षित नामों का दुरुपयोग करना चाहिए।

रजिस्ट्रेशन प्रक्रिया

नाम, उद्देश्य और प्रबंध समिति (अध्यक्ष, सचिव, कोषाध्यक्ष) तय करें
मेमोरेंडम और उपविधि का मसौदा बनाएं
सदस्यों के दस्तावेज़ और हस्ताक्षर इकट्ठे करें
रजिस्ट्रार के पास आवेदन और दस्तावेज़ जमा करें (राज्य पोर्टल / ई-मित्र से ऑनलाइन, या कार्यालय में)
रजिस्ट्रार दस्तावेज़ों की जांच करता है
पंजीकरण प्रमाणपत्र जारी होता है

आमतौर पर लगभग 4–8 सप्ताह लगते हैं।

फीस

सरकारी फीस राजस्थान सरकार तय करती है और सोसाइटी के लिए सामान्यतः कम होती है, साथ में दस्तावेज़ों पर स्टाम्प ड्यूटी लगती है। प्रोफेशनल शुल्क अलग है।

फाइलिंग से पहले मौजूदा फीस रजिस्ट्रार से पक्की कर लें।

रजिस्ट्रेशन के बाद

सोसाइटी के नाम से बैंक खाता खोलें
नियमित बैठकें करें और हिसाब व कार्यवृत्त रखें
ज़रूरत अनुसार वार्षिक जानकारी और प्रबंध समिति में बदलाव रजिस्ट्रार को दें
PAN अलग से बनवाएं, और चाहें तो 12A व 80G जैसे कर लाभ के लिए आवेदन करें
