A trademark is a name, logo, slogan, sound, shape or colour combination that tells customers whose goods or services they are buying. Registration under the Trade Marks Act, 1999 gives you the exclusive right to use the mark for your registered goods or services, and lets you take legal action against copying. You can then use the ® symbol; while the application is pending you may use ™.

Marks are registered under one or more of 45 classes (1–34 goods, 35–45 services). Protection applies only to the classes you file in.
Any individual, sole proprietor, startup, MSME, partnership, LLP, company, trust or society, and foreign applicants too (with an address for service in India). You can file even before launching the brand.
Timeline depends on objections, hearings and opposition. Faster examination is available for an extra fee.

ट्रेडमार्क ऐसा नाम, लोगो, स्लोगन, ध्वनि, आकार या रंग संयोजन है जो ग्राहकों को बताता है कि सामान या सेवा किसकी है। ट्रेड मार्क्स अधिनियम, 1999 के तहत रजिस्ट्रेशन से आपको अपने पंजीकृत सामान या सेवाओं के लिए मार्क के उपयोग का विशेष अधिकार मिलता है, और नकल करने वालों पर कानूनी कार्रवाई कर सकते हैं। इसके बाद आप ® चिह्न लगा सकते हैं; आवेदन लंबित रहने तक ™ लगा सकते हैं।

मार्क 45 क्लास में से एक या अधिक में रजिस्टर होता है (1–34 सामान, 35–45 सेवाएं)। सुरक्षा सिर्फ उन्हीं क्लास में मिलती है जिनमें आप फाइल करते हैं।
कोई भी व्यक्ति, प्रोपराइटर, स्टार्टअप, MSME, पार्टनरशिप, LLP, कंपनी, ट्रस्ट या सोसाइटी, और विदेशी आवेदक भी (भारत में सेवा का पता देकर)। ब्रांड लॉन्च से पहले भी फाइल कर सकते हैं।
समय आपत्ति, सुनवाई और विरोध पर निर्भर करता है। अतिरिक्त फीस देकर तेज़ जांच भी मिलती है।
